Federal Court Rules On Dominican Man's Extradition Case

(Providence, RI)--There is federal court action in Providence this week regarding the case of a man wanted for the fatal shooting of a police officer in the Dominican Republic.Judge John McConnell Jr. on Wednesday dismissed an extradition complaint for Cristian Aguasvivas based on a Board of Immigration Appeals determination that he would have likely been tortured by police upon returning to the DR.The court ruled that there was no basis to decide that one arm of the executive branch - the immigration appeal board - can make a determination, and another arm - the State Department - can ignore that determination.The Providence Journal reports McConnell agreed to temporarily stay the immediate custody release of Aguasvivas pending a telephone conference today.
